-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.121 dated 1.12.2020 registered under Sections 384, 387, 506, 34 IPC at Police Station Rori District Sirsa.

The counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He being Sarpanch of the village tried to mediate to resolve the dispute between the parties relating to FIR, which was got registered by Monika against the complainant under Section 376(d) IPC, which was later on cancelled. The counsel for the petitioner further submits that the petitioner was not named in the FIR and has not received any money or car from the complainant and has got no relationship with the aforesaid Monika, who is alleged to have honey-trapped the complainant. The counsel for the petitioner further submits that the petitioner has joined investigation with the police by virtue of order dated PUNEET CHAWLA 2022.10.12 10:42 I attest to the accuracy and authenticity of this order/judgment

( 2 ) CRM-M-25329-2022 2.6.2022 passed by the Coordinate Bench of this Court on three occasions and has cooperated with the police.

State counsel on instructions from SI Chandan Singh has not refuted the fact that the petitioner who was not named in the FIR has joined investigation and further submits that the petitioner is not required by police for further investigation or for custodial interrogation. Admittedly the main accused namely Nirmal Singh has been granted concession of interim bail by this Court in CRM-M-11113-2022 vide order dated 16.3.2022. The petitioner who was not named in the FIR has already joined investigation with the police. In the FIR, specific allegations regarding demand of money and car are against aforesaid Nirmal Singh only. The complicity of the petitioner, if any, will be unfolded only during the trial.

In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 2.6.2022 passed by the Coordinate Bench of this Court is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
