**** ANITA CHAUDHRY, J (ORAL) Through the instant petition, the petitioner is seeking anticipatory bail in case FIR No. 109 dated 26.7.2016, registered under Sections 498-A, 494, 406, 420, 120-B IPC, Police Station Dayalpura, District Bathinda.

A complaint had been lodged by the wife that during the subsistence of the first marriage, the husband had married again. There are allegations of cruelty, harassment and fraud and the threats being given by the petitioner.

Counsel for the petitioner submits that the petitioner has not married any other woman, at the most, the allegations would be of illicit relationship and the complainant is residing in the matrimonial home with his mother.

No. M-34630 of 2016 -2Counsel for the complainant urges that Karamveer Kaur filed a petition bearing No. CRM-M-28765 of 2016 which is fixed for today and she had filed petition under Section 9 of the Hindu Marriage Act and it was pleaded that she was married to Jaskaran for the last four years and Karamveer Kaur had taken a plea in her bail application that she did not know about the earlier marriage and fraud had been played to her and contradictory stands are being taken.

During the course of submissions, Counsel for the complainant has produced copy of the petition filed under Section 9 of the Hindu Marriage Act. The petition was filed in January 2016 before lodging of this FIR therein the reference to the marriage between Karamveer and Jaskaran is said to have taken place four years ago. The petitioner is denying his second marriage.

No case for anticipatory bail is made out.

Petition is dismissed.
