Mr. Hakam Singh, Assistant Advocate General, Punjab. ASHOK KUMAR VERMA, J. (ORAL) Reply dated 05.09.2019, filed by way of affidavit of Sh. Jaspal Singh, Deputy Superintendent of Police (Detective) Moga, District Moga, on behalf of respondents No. 1 to 4 is taken on record. Despite the case having been called twice, none has put in appearance on behalf of the petitioner.

Perusal of the file shows that on the previous date also i.e. 24.01.2020, the petitioner had gone un-represented. Therefore, it can safely be presumed that the petitioner or his counsel is no more interested in pursuing the instant petition.

Moreover, as per averments made in the reply the petitioner has filed the present petition for directing respondent No. 4 to decide the representation dated 01.04.2019 (Annexure P-2). It has been averred in the reply that no such representation was received in the office of RISHU KATARIA 2022.10.17 12:31 I attest to the accuracy and authenticity of this document

CRM-M-17368-2019 -2respondent No. 4 and there is no apprehension to the life and liberty of the petitioner. In fact, two cases bearing (i) FIR No. 52 dated 05.06.2016, under Sections 452, 506, 380, 427, 148 and 149 IPC, Police Station Smalsar and (ii) FIR No. 180 dated 01.11.2016 under Sections 452, 506, 323, 427, 149 IPC, Police Station Baghapurana, have been registered against the petitioner and trial in both cases is pending before the trial Court.

In view of the above and averments made in the reply filed by the respondents, this petition is dismissed on two following counts:- (i) for want of prosecution; and (ii) being meritless.
