**** ANITA CHAUDHRY, J(ORAL) This is the second petition filed by the petitioner seeking regular bail in FIR No. 387 dated 5.9.2015 registered at Police Station Urban Estate Rohtak, District Rohtak under Sections 304-B, 34, 498-A, 306 IPC.

Petitioner is the mother-in-law who is in custody since 17.9.2015.

Counsel for the petitioner contends that the private witnesses have turned hostile and the trial would take time. Counsel further contends that two sisters are married in the same family and the other sister is living happily in the house and Vandana PW-9 had stated that the deceased was under depression and mental stress as she could not conceive. State counsel has opposed the bail application and urges that when the Court was not inclined to grant bail and was going to dismiss the first application, the counsel appearing for the petitioner had withdrawn the Gurpreet Singh Bhatia 2016.10.06 11:54 I attest to the accuracy and authenticity of this document High Court Chandigarh

Crl. Misc. No. M-34638 of 2016 -2petition on 4.7.2016 and the witnesses who had turned hostile were examined prior to June 2016 and there is no change in the circumstances and there is a suicide note and the deceased made accusations against the mother-in-law. State counsel further contends that 13 PWs have been examined out of 20 witnesses and the trial would come to a close shortly. The trial Court has to consider the statements made by the witnesses. The deceased had left behind a suicide note which is also to be considered by the trial Court at the appropriate stage. There are specific allegations against the petitioner. The allegations are serious. The trial is going at a fast pace.

No ground for bail is made out.

Petition is dismissed.
