State of Punjab .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.BS Jaswal,Advocate for the petitioners Jaswant Singh,J.(Oral) Three petitioners/accused are seeking a direction to get the investigation conducted from an independent agency in FIR No.39 dated 12.6.2012 under Sections 302,307,148,149,120-B IPC and 25/27/54/59 of the Arms Act,PS Purana Shalla,Distt.Gurdaspur. The prayer is based on an inquiry report dated 14.9.2012(P-2) submitted by DSP Gurdaspur.

At the time of hearing, it is conceded that after filing of the challan and framing of charge the prosecution has led evidence of two witnesses. It also cannot be disputed that report P-2 is based on inquiry and not investigation based.

After arguing for sometime and having failed to convince the Court,learned counsel seeks permission to withdraw the present petition.

Dismissed as withdrawn.
