After hearing learned counsel for the parties, it appears that prima facie the allegations against the petitioner are that he is a witness to Power of Attorneys, which have been used by Hardeep Singh to sell the property beyond the share of the original owner. The connivance of the petitioner with the main accused, who has been arrested and granted the concession of bail, will be a debatable issue as the matter is also pending before the civil court. Since the litigation is sub judiced before the civil court and has gone in second appeal in RSA, it will not be appropriate to express any opinion regarding authenticity of the documents referred to by counsel for the parties and forming part of the report u/s 173(2) Cr.P.C. The petition is allowed. Interim order dated 27.1.2016 is hereby made absolute subject to all the conditions u/s 438(2) Cr.P.C. March 28 ,2016 ( M.M.S.BEDI ) TSM JUDGE
