Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Vinod @ Sonu, who has been booked for having committed the offence punishable under Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985, in a case arising out of FIR No.247, dated 22.05.2015, registered at Police Station, Sampla, District Rohtak.

Learned counsel contends that as per prosecution version, 330 grams charas of non-commercial quantity was allegedly recovered from the petitioner on 22.05.2015 and since then, he is behind the bars; the petitioner was earlier involved in three more cases but has been acquitted in all the said cases SEEMA RANI 2015.10.07 16:11 I attest the accuracy and authencity of the document

Criminal Misc.No.M-33808 of 2015 [2] and that after completion of the investigation, the charge-sheet (report under Section 173, Cr.P.C.) has been presented. Learned counsel for the State has not controverted the fact that the recovery effected from the petitioner is of noncommercial quantity and he is behind the bars from 22.05.2015. He further concedes that the charge-sheet (report under Section 173, Cr.P.C.) has been presented before the Court below. In view of the above, the present petition is accepted. Petitioner-Vinod @ Sonu, s/o Rajinder @ Baba, r/o village Gandhra, District Rohtak, is ordered to be released on bail during pendency of trial of the present case subject to his furnishing bonds to the satisfaction of learned Judge, Special Court, Rohtak.
