The present appeal was filed in the year 2019 along with an application for condonation of delay of 323 days. Perusal of interlocutory orders on record would show that no effort has been made by learned counsel for the appellant to address arguments even for once. Again, it was adjourned on 09.09.2019, 18.09.2019 and 16.01.2020 when the Court was constrained to observe that despite four consecutive request for adjournment, learned counsel for the appellant sought time.
Last opportunity was granted to learned counsel for the appellant.
Today also, none has appeared despite two pass overs.
This Court has no alternative, but to dismiss the appeal for non-prosecution.
