Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.69 dated 07.03.2015 under Sections 148, 149, 323, 324, 325, 326, 452, 307, 302 and 506 IPC, registered at Police Station Sadar Ballabgarh, District Faridabad. Notice of motion was issued and learned State counsel as well as learned counsel for the complainant appeared and contested the petition.
I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. In the present case, the challan has already been VINEET GULATI 2015.10.09 16:07 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-33820 of 2015 -2presented and charges have also been framed but no PW has been examined and the case is at preliminary stage. The present petitioner is named in the FIR and he along with other co-accused had taken active participation in the commission of the offence. The petitioner is stated to be armed with danda and he gave simple injuries to the deceased.
Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and in view of the fact that the petitioner has participated in the commission of offence and caused simple injuries to the deceased along with other co-accused, I do not find it a fit case where petitioner is entitled to benefit of regular bail. There is every possibility that petitioner may tamper with the evidence if he is granted bail and he may abscond also. Therefore, finding no merit in the present petition, the same is dismissed.
