Ms. Mahima Yashpal, AAG, Haryana **** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 79 dated 5.6.2017 registered at Police Station Khizrabad, District Yamuna Nagar under Sections 376(D), 292-A, 379-A, 506 IPC and Section 3(xii) of SC/ST Act, 1989.

Petitioner is in custody since 15.6.2017. The petitioner was not named in the FIR. The allegations are that the co-accused had named him. The prosecutrix has now turned hostile and did not support the prosecution and did not identify the petitioner.

Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
