The present petition has been filed under Article 227 of the Constitution of India for issuance of a direction to the Additional District Judge, Yamuna Nagar at Jagadhri (for short - the Executing Court) to dispose of the execution application filed by the petitioner in a time bound manner.
After hearing learned counsel for the petitioner and perusing the record, it is found that on 06.02.2016, the petitioner filed an application before the Executing Court seeking therein to execute order dated 30.07.2015 passed by the Additional District Judge, Yamuna Nagar at Jagadhri. Through the aforesaid order, the land acquisition references preferred by the petitioner had been partly accepted. The petitioner's execution application, even after the passage of MONIKA 2019.04.24 12:03 I attest to the accuracy and integrity of this document
C. R. No. 2511 of 2019 over three years and two months, is still pending, in which the Executing Court is found to be rather lenient in granting adjournments to the State for making payment to the petitioner.
In view of the above factual position as also for the reason that a litigant has a right to speedy disposal of his/her case, the Executing Court is directed to dispose of the petitioner's execution application within four months from the date of receipt of a certified copy of this order. The petition is allowed in the above terms.
If the respondents are aggrieved by passing of the present order, they are at liberty to approach this Court by filing of an appropriate application.
