This is a petition under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India for initiation of proceedings against the respondents for willfully and intentionally misrepresenting before the Court in CRM-M-57898-2024 decided on 06.02.2025.

Learned counsel for the petitioner has pointed out that the petitioner had filed a petition for grant of anticipatory bail in which the State counsel had placed on record a copy of communication dated 05.02.2025 to submit that the Police had filed an untraced report. The learned counsel for the petitioner has further pointed out that thereafter despite having stated before the Court that an untraced report had been filed, the house of the petitioner was raided by the Police officials under the pretext of arresting him in the FIR.

Per contra the learned counsel for the State, on instructions from SI Balwant Singh, SHO Police Station Division No.5, Ludhiana, states that the raid was not conducted by the Police officials but was conducted by the Enforcement Department on 28.02.2025. It has further been pointed out that an untraced report has now been placed before the Duty Magistrate on 31.03.2025 in FIR No.194 dated 26.10.2024 under Sections 61(2), 318 (4) of the Bharatiya Nyaya Sanhita, 2023 and Sections 10 and 24 of the Emigration Act, 1983.

In view of the above, the learned counsel for the petitioner states that he does not wish to press the present petition. 5.
Dismissed as not pressed. Pending applications, if any, also stand disposed off.
