(ORAL) Petitioner is seeking the concession of regular bail under Section 439 of the Code of Criminal Procedure, 1973 in case FIR No.321 dated 05.12.2023 registered under Sections 15-C of the NDPS Act, 1985, at Police Station Nangal Chaudhri, District Narnaul. 2.

At the outset, learned State counsel has opposed the prayer made by the counsel opposite for extending the concession of bail to the petitioner. Learned State counsel, on instructions from Inspector Devender, has informed the Court that the petitioner was apprehended at the spot pursuant to a secret information and thereafter a huge recovery of 203.600 kilograms of poppy husk affected from him. Learned counsel has submitted that after the petitioner was arrested on 05.12.2023, the investigation was still underway as even challan had not been presented.

In the facts and circumstances as enumerated hereinabove, no ground is made to extend the concession of regular bail to the petitioner.

The instant petition stands dismissed.
