Petitioner is seeking transfer of trials in cases bearing FIR No. 680 dated 21.12.2013, registered for offences punishable under Sections 465 and 469 IPC and 66-A and 66-D of the Information Technology Act, 2000, at Police Station Yamunanagar City and FIR No. 1472 dated 03.10.2017, registered for offences punishable under Sections 323, 341, 506 read with Section 34 IPC, at Police Station Jagadhari City, District Yamunanagar.

Learned counsel for private respondents submits that only purpose of petitioner is to keep trial in aforesaid cases pending, which has JITENDER KUMAR 2019.07.26 10:56 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-34853 of 2018 -2already been delayed. He has, however, no objection if the trial of both the cases are transferred to Kurukshetra a place near Yamunanagar. Learned counsel for petitioner also agrees with proposal of learned counsel for respondent to transfer both the cases to Kurukshetra. In view of submission of learned counsel for parties, both the trials are transferred to Court of Chief Judicial Magistrate, Kurukshetra. Learned trial Court, Yamunanagar at Jagadhari is directed to send files of both the cases to Chief Judicial Magistrate, Kurukshetra, where proceedings will be initiated w.e.f. 05.08.2019.

Chief Judicial Magistrate, Kurukshetra is directed to list the cases at least once in fortnight and ensure that the entire evidence of the prosecution is recorded within six months and trial of the cases is completed within nine months of the receipt of copy of this order.
