Counsel for the petitioners has submitted that no offence against the petitioners is made out and that the sanction to prosecute them vide order dated 13.7.2016 is without application of mind and contrary to the opinion of the SDM, who was required to look into the record. After arguing for some time, counsel for the petitioners seeks permission to withdraw the petition lest it should disclose the legal defence, to be taken by the petitioners during trial, with liberty to raise all the pleas on merits as well as regarding the illegality and impropriety of the order, which the petitioners claim has occasioned in failure of justice. Disposed of as withdrawn with liberty to the petitioners to raise all the pleas at an appropriate stage during trial.
