Petitioner has filed the second petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 146 dated 21.11.2013 under Section 15, 25 of Narcotic Drugs and Psychotropic Substances Act, 1985 ('Act' for short), registered at Police Station Sangat, District Bathinda. As per the status report placed on record by the learned State counsel, petitioner is suffering from AIDS and is HIV Positive. Petitioner is undergoing treatment at ART Centre, Civil Hospital, Bathinda. At present, petitioner does not require any medicine and would be taken to the hospital for medical check-up on 24.1.2016. Learned State counsel has submitted that now the case is listed before the Trial Court for defence evidence. In view of the above facts, no ground for grant of bail to the petitioner is made out.
Dismissed.
