 !"#  $ Allegations against the petitioner Shish Ram in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.3 dated 01.09.2015 registered at Police Station Women, Narnaul, District Mahindergarh under Section 354A IPC and Section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, are that on 01.09.2015 he along with other co;accused/non; applicants have assaulted complainant Reshma.     Contentions of learned counsel for the petitioner that the petitioner is in custody since 09.09.2015, for more than one month, and is handicapped as he is crippled by both legs and is unable to walk and it is a pure case of animosity over local politics, though are sought to be controverted by learned State counsel Mr. Munish Sharma, Asstt. Advocate General, Haryana as well as on behalf of the complainant by Mr. S.K. Panwar, Advocate submitting that in view of the nature of the allegations disentitles the petitioner from the relief sought.

However, appreciating these submissions in the light of contentions of learned counsel for the petitioner and the fact that culpability, if any, shall be determined at the trial coupled with the fact that the trial will take a long time to conclude, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of Chief Judicial Magistrate/ Duty Magistrate. The present petition stands disposed off accordingly. #  !$   %&'() "
