This revision petition has been filed under Article 227 of the Constitution of India assailing order dated 29.03.2022, Annexure P-3, passed by the learned appellate authority, whereby on an application moved by the respondents-land owners, appellate authority determined the mense profits of Rs.45,000/- per month.

Counsel for the petitioner submits that while issuing notice of motion to the respondent on 08.08.2022, this Court fixed the mense profits of Rs.14,000/-, per month, payable by the petitioner-tenant from the date of passing of ejectment order dated 19.03.2019, Annexure P-1. He further submits that the entire arrears amount in terms of order passed by this Court have been deposited, and the petitioner is regularly depositing the mense profit. Counsel for respondent No.1, upon instructions, submits that he is prepared to accept the mesne profit at the rate of Rs.14,000/-, per month, as assessed by this Court. He further submits that as the appeal against the eviction order, Annexure P-1, is pending for the last almost six years, a direction be issued to the appellate authority to decide it in a specific time frame.

The request made by counsel for respondent No.1, appears to be reasonable. Accordingly, it is expected that the appellate authority shall make an endeavour and decide the appeal as expeditiously as possible, preferably within a period of six months, from the date of communication of a copy of this order.

Petition is disposed off.
