Ms.Rajni Gupta, Addl.A.G.,Punjab.
Rajan Gupta, J (Oral) This is a petition under Section 438 Cr.P.C seeking pre-arrest bail to the petitioners vide FIR No.79 dated 31.8.2013 under Sections 420, 406, 506, 120-B IPC registered at Police Station, Kathunangal, District Amritsar.
Learned State counsel submits that proclamation proceedings are pending against all the accused. Besides, keeping in view the serious nature of allegations levelled against the petitioners, they are not entitled to concession of pre-arrest bail.
Petitioners remain unrepresented despite the fact that case has been called out twice since morning. FIR was registered on the statement of Gurinder Singh. He alleged that petitioners were working as Labourers on the brick kiln. They demanded advance money to carry on work on the brick kiln but thereafter did not turn up for work. Thus, complainant had been cheated by the accused.
In view of the facts and circumstances of the case, no case for pre-arrest bail is made out.
Dismissed.
