(ORAL) A pasted envelope, purportedly containing the report of the Warrant Officer, is already tagged with the paper-book. The same has been opened in the presence of learned counsel for the petitioner as well as learned State counsel and it is found to be containing the report of the Warrant Officer (along-with one copy thereof) and certain other documents annexed therewith.

As per the said report, the alleged detenue could not be found at the places disclosed by the petitioner. Learned State counsel has also forwarded the status-report to this Court, through email and the same has been placed on the record. As specifically mentioned in Para No.5 thereof, the alleged detenue made a statement before the Illaqa Magistrate under Section 164 Cr.P.C. and as per Para No.8, her custody has already been handed over to her parents.

At this stage, learned counsel for the petitioner submits that in view of the above-discussed facts and circumstances, the instant petition has become infructuous and he seeks permission to withdraw the same.

Learned State counsel has no objection for the same. Accordingly, the petition in hand stands dismissed as withdrawn for having been rendered infructuous. (MEENAKSHI I.
