******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 38 dated 22.03.2016 registered for the offences punishable under Sections 307, 341, 506, 120-B read with Section 34 of Indian Penal Code and 27 of Arms Act at Police Station Nehianwala, Bathinda Heard.
Learned counsel for the petitioner submits that petitioner has surrendered before the trial Court and has been allowed interim bail under oder dated 29.09.2017.
Learned State counsel on instructions from ASI Jasdev Singh also endorses the submission of learned counsel for the petitioner. Keeping in view the fact that the petitioner has surrendered Jyoti 2017.12.13 15:29 I attest to the accuracy and authenticity of this document
CRM-M-34053-2017 -2before the trial court and has been allowed interim bail, the trial is in progress, this petition is allowed and the order dated 29.09.2017 is made absolute subject to the condition that petitioner will keep on appearing on each and every date of hearing. In the event of his non-appearance on any date without permission, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and proceed against him in accordance with law.
The trial Court will, however, be at liberty to proceed against the petitioner under Section 446 Cr.P.C. and take appropriate action in accordance with law.
