The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue him passport.

The petitioner vide application dated 06.02.2024 (Annexure P7) applied for re-issuance of passport. The respondents on account of pendency of two criminal cases arising out of FIR No. 343 dated 06.09.2002, under Sections 323, 324, 148, 149 of IPC and FIR No. 355 dated 11.10.2001, under Sections 324, 148, 149 of IPC, registered at Police Station Nakodar, District Jalandhar have not re-issued passport. The petitioner was declared proclaimed offender in both the FIRs. seeking setting aside of orders of proclamation. This Court vide orders dated 03.04.2024 (Annexures P-9 and P-10) has directed him to appear before trial court and till then, operation of orders of proclamation has been stayed.

Mr. L.S.Mann, Advocate, submits that petitioner is staying out of country and he wants to join proceedings arising out of aforesaid FIRs. His passport expired on 24.03.2024. The passport authority should be directed to re-issue him passport.

Mr. K.K.Jund, Senior Panel Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. He assures the Court that keeping in mind orders dated 03.04.2024 passed by this Court in CRM-M-48871 of 2022 and CRM-M- 53596 of 2022, the passport authority would look into grievance of the petitioner and pass an appropriate order within 10 days from today.

Counsel for the petitioner agrees to the aforesaid arrangement. 7.

In the wake of statement of both sides, the petition stands disposed of.
