 ****  $ % Petitioner-Kamaljit Singh alias Kamal, has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No.0103 dated 31.05.2017, registered at Police Station Basti Bawa Khel, District Jalandhar, under Sections 306 and 34 of the Indian Penal Code.

Notice of motion was issued in this case. Learned State counsel has put in appearance on behalf of the respondent-State and contested the instant petition.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that as per prosecution version, the present petitioner is the main accused. Further, the challan has already been presented and the charges are yet to be framed.  && stage. Moreover, Deepak Kumar, has committed suicide on account of threats given by the present petitioner and other co-accused. Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and the fact that the case is at preliminary stage and the petitioner can tamper with the evidence, therefore, at this stage, I do not find it a fit case where the petitioner is entitled to benefit of regular bail.

Therefore, finding no merit in the instant petition, the same is dismissed.
