NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No. 52 dated 30.04.2019 registered under Sections 302, 313, 314, 316, 201 and 120-B IPC at Police Station Sadar Batala, District Gurdaspur. Learned counsel for the State has filed custody certificate dated 23.04.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 02 years, 02 months and 02 days.
After arguing for some time, when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.
Permitted to do so.
Dismissed as withdrawn, at this stage.
