Present writ petition has been filed for directing respondents No.2 and 3 to remove the brick floor illegally constructed on the private property of the petitioner which was kept vacant by the petitioner for his personal use which is illegal and arbitrary and further to direct respondents No.2 and 3 to direct respondent No.4 to close his doors illegally opened in the property of the petitioner as shown in the images annexed with this petition.

Learned counsel for the petitioner has drawn the attention of this Court to the photographs attached with the petition as Annexure P-2 and has submitted that in front of the house of the petitioner, the bricks are lying dumped since 1993 by the respondent-Nagar Panchayat and despite repeated requests, till date same are not being removed and thus, the petitioner is restrained from using his property. CWP No.9887 of 2024 -2- 2024:PHHC:059690 the petitioner has further submitted that for the redressal of his grievance, the petitioner has already filed representation dated 08.04.2024 (Annexure P-4) before respondents No.2 & 3, but no action has been taken on the same till date.

Notice of motion to respondents No.1 to 3 at this stage. 4.

On asking of the Court, Mr. Navneet Singh, Sr. DAG, Punjab and Mr. Vikrampreet Arora, Advocate appear and accept the notice on behalf of respondent No.1-State and respondents No.2 & 3. 5.

Learned counsel for respondents No.2 and 3 has submitted that the necessary action on the representation filed by the petitioner dated 08.04.2024 (Annexure P-4) would be taken expeditiously in accordance with law.

In view of the above position, the present petition stands disposed of with a direction to respondent No.2 i.e. The Executive Officer, Nagar Panchayat, Handiaya, Barnala, Punjab to look into the representation of the petitioner dated 08.04.2024 (Annexure P-4) and decide the same in accordance with law within a period of two weeks from the date of receipt of copy of the order.
