PARAMJEET SINGH DHALIWAL, J. (ORAL) This is a petition filed under Section 438 Cr.P.C. for grant of concession of pre-arrest bail to the petitioner in case FIR No.200 dated 10.09.2012 registered under Sections 498-A/323/506 IPC at Police Station Sushant Lok, Gurgaon.
I have heard petitioner and complainant, who are present in Court, and perused the record.
Parties state that they have effected compromise. Complainant states that in view of the compromise, she has no objection if the interim order dated 31.10.2013 as well as subsequent order dated 11.09.2014 whereby petitioner has been granted permission to join his duty, are made absolute. Parties state that they will be bound by the latest agreement in pursuance to which already petition under Section 13-B of RAVINDER SINGH 2016.03.09 16:37 I attest to the accuracy and authenticity of this document
-2Crl. Misc. No. M-36905 of 2013 the Hindu Marriage Act has been decided. Photocopies of documents i.e. joint statement of the parties dated 12.01.2016, joint statement dated 01.02.2016 before the Family Court, Gurgaon and order dated 03.02.2016 passed by learned District Judge, Family Court, Gurgaon passed in petition under Section 13-B of the Hindu Marriage Act, are taken on record as Ex.CX, CY & CZ, respectively. In view of the above, order dated 31.10.2013 as well as subsequent order dated 11.09.2014 are made absolute. Registry is directed to release the documents mentioned in last para of order dated 14.08.2014 to the complainant, after breaking open the seals, under signatures of both the parties which shall be identified by learned counsel for the parties. The documents be returned forthwith so that the same may be used by the complainant for further purposes, if any.
Petition disposed of accordingly.
Copy of this order be given to the petitioner and complainant under signatures of the Bench Secretary.
