RAMENDRA JAIN, J. (ORAL) Custody certificate filed in Court today is taken on record. Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Paramjit Kaur in a case arising from FIR No.124 dated 11.05.2017 under Sections 419, 420, 467, 468, 471 and 120-B IPC registered at Police Station Division No.5, District Ludhiana.
Learned counsel for the petitioner inter alia contends that the petitioner is in custody since 18.07.2017. She is not named in the FIR. No role whatsoever has been attributed to the petitioner. She has wrongly and illegally been arrested and has been confined in jail. She has nothing to do with co-accused G.S. Bawa, who is named in the FIR. As on today, FSL report regarding signatures of the petitioner has not been received. Final report has been filed. Conclusion of trial shall take long time. No useful purpose would be served by detaining the petitioner in jail. On the other hand, learned State counsel, on instructions from ASI Malkit Singh, vehemently opposed the prayer for grant of regular bail
-2CRM-M-34151 of 2017 to the petitioner submitting that the petitioner, who is a land-shark and land grabber, has formed a gang. The petitioner by impersonating herself as Harbans Kaur, actual owner of Plot No.64 C situated at Bhai Randhir Singh Nagar, Ludhiana, in connivance with co-accused G.S. Bawa, tried to grab the plot of the complainant in an illegal manner. The petitioner has been booked in two more cases of similar nature. They are always in search of unattended property of the NRIs and other innocent people and by preparing fake and forged documents usurp the same. Name of the petitioner is very much mentioned in the FIR.
Considering overall facts and circumstances, this Court is of the view that petitioner does not deserve the concession of regular bail being a land-shark and land grabber by forging and preparing fake documents of the absentee landlords.
Accordingly, the petition is dismissed.
