Beer Singh v. Om Parkash And Another
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH 218A RSA No. 3270 of 2002 (O&M) DATE OF DECISION :- 10.12.2025 Beer Singh ...Appellant
Versus
Om Parkash and another
...Respondents
CORAM:
HON'BLE MR. JUSTICE VIRINDER AGGARWAL Present:- Mr. Amit Jain, Senior Advocate with Ms. Aeshna Jain, Advocate for the appellant.
Mr. B.K. Bagri, Advocate for the respondents. *** VIRINDER AGGARWAL , J. (Oral) 1.
Learned counsel appearing for the appellant pleaded no instructions. Thereafter, notice to the appellant was issued and as per the report of the office, sole appellant has died and no application for impleading the LRs has been filed by the LRs of the appellant. It seems that LRs of the appellant are not interested in pursuing the instant appeal. 2.
In view of the above and given the prevailing circumstances, there seems to be no justification to keep the appeal on the docket, indefinitely. Accordingly, the instant appeal stands dismissed for want of prosecution with liberty to the LRs of the appellant to revive the same, if have any grievance from this order, within a period of three months from today. 3.
Since the main appeal stands decided, the miscellaneous application(s), if any, stand disposed of accordingly.
