In view of commercial quantity of intoxicating powder recovered from the petitioner, which contained Diphenoxylate Hydrocholoride, no ground is made out to grant the concession of regular bail to the petitioner.

I have considered the contention of counsel for the petitioner that the petitioner after having been arrested on 22.5.2014, had been granted interim bail on 22.7.2014 and on receipt of report of Chemical Examiner, he has been taken back in custody on 23.8.2016. It is urged that the petitioner has not misused his liberty during the period of interim bail. Interim release of the petitioner for non receipt of report of FSL will not ipso facto confer a right that the petitioner be granted the concession of bail in contravention to the provisions of Section 37 NDPS Act. However, the trial is directed to conclude the trial expeditiously, preferably within a period of six months after the next date of hearing fixed before it. Dismissed with the above observations.
