***** VIKAS BAHL, J (ORAL) This is a civil writ petition filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus for directing respondent No.3 to decide an application for partition proceedings with regard to the land measuring 34 kanals 13 marlas situated in the area of Village Safu Wala, Tehsil and District Moga, after remand order dated 18.07.2018 (Annexure P-3) and order dated 07.02.2020 (Annexure P-4) passed by respondent No.1.

Learned counsel for the petitioner has submitted that after the matter was remanded, the case was revived but on 08.11.2021, the same has been consigned to record room. It is submitted that thereafter, the petitioner has moved an application dated 20.12.2022 (Annexure P-6) and the said application has not been decided till date.

Learned counsel for the petitioner has prayed that the petitioner would be satisfied in case a direction is given to the Assistant Collector Ist DINESH BANSAL 2023.04.21 10:06 I attest to the accuracy of this order Chandigarh

CWP No.7949 of 2023 -22023:PHHC:054510 Grade, Moga to decide the application dated 20.12.2022 (Annexure P-6) as expeditiously as possible.

Learned State counsel has submitted that the Assistant Collector Ist Grade, Moga would decide the said application as expeditiously as possible. He has further submitted that the same would be done only in case the said application (Annexure P-6) has actually been filed. Keeping in view the above facts and circumstances of the case, the present petition is disposed of with a direction to the Assistant Collector Ist Grade, Moga to decide the application dated 20.12.2022 (Annexure P-6) as expeditiously as possible.
