The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking directions to respondents No.1 and 2 to issue passport.

The petitioner vide application dated 19.07.2022 applied for the passport. An FIR No.0235 dated 09.10.2021, under Sections 341, 323, 324, 506, 148 and 149 of IPC was registered against the petitioner. The petitioner in the investigation was found innocent and cancellation report was prepared which is yet to be submitted before trial Court. The petitioner vide letter dated 10.03.2023 requested the respondent to issue passport because he has been found innocent in the investigation. 3.

Learned State counsel on instructions from ASI Satpal Singh submits that it is factually correct that the petitioner, during investigation, ANJU GOEL 2023.08.31 16:37 I attest to the accuracy and integrity of this document

CWP-7842-2023 -22023:PHHC:114115 has been found innocent, however, cancellation report is yet to be submitted.

The case of the petitioner is squarely covered by the judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others, CWP No. 27167 of 2018 disposed of vide judgment dated 14.07.2023. 5.

Faced with this, learned counsel for respondents No.1 and 2 submits that the competent authority would decide application of the petitioner within 06 weeks from today.
