Petitioner has sought transfer of investigation of the FIR in question. Stand of counsel for the petitioner is that there is no evidence on record against the petitioner. He is residing abroad. FIR was registered in his absence. Same needs to be transferred to an independent agency. Prayer has been opposed by learned State counsel. According to her, investigation has already been completed and challan presented before competent court. Thus, no case for its transfer to an other agency is made out. I have heard learned counsel for the parties. FIR was registered on the allegations that accused were indulging in unlawful activities. They were in regular contact with certain anti national elements and were inciting the youth to carry out activities which would harm peaceful atmosphere of Punjab. Admittedly, petitioner is a proclaimed offender. He never associated with the proceedings pursuant to FIR.
