AMIT RAWAL J. (Oral) Learned counsel for the appellants submits that appellant no.2 has died and his LRs are not coming forward to pursue the matter, therefore, he is unable to bring them on record.

The appeal is of 1999 against the judgment and decree dated 29.05.1999 of the Lower Appellate Court vide which appeal of the respondent was allowed.

In such circumstances, I am of the view that no purpose would be served in keeping the appeal pending.

Dismissed for non-prosecution.

Interim order dated 06.01.2003 passed by this Court stands vacated.
