The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking quashing of FIR No.310 dated 09.11.2020 under Sections 420, 120-B, 506 IPC (Sections 465, 467, 468, 471, 447 IPC added later on) registered at Police Station Shahkot, District Jalandhar Rural and all subsequent proceedings arising therefrom on the basis of compromise dated 22.03.2025 (Annexure P-2). 2.

Vide order dated 03.04.2025 of this Court, the parties were directed to appear before the learned trial Court/Illaqa Magistrate on or before 10.05.2024 for getting their statements recorded regarding the compromise arrived at between them and the Court concerned was further directed to send the report qua the compromise so arrived at between them. 3.

In pursuance thereof, report has since been received from learned Judicial Magistrate Ist Class, Nakodar, wherein the factum of the compromise arrived at between the parties stands verified and confirmed. As per the report, Sonia Puri 2025.07.09 13:17 I attest to the accuracy and integrity of this document

CRM-M-16719-2025 (O&M) -2-    compromise has indeed been effected between the parties and the same is without any pressure or coercion and out of their free will, and the complainant and the injured have also made statement to the effect that they would have no objection if the FIR qua the accused-petitioners is quashed. 4.

The Trial Court has annexed a copy of the statements of the parties so recorded, alongwith its report.

Learned State counsel also submits that there is no accused person other than the petitioners and respondent No.2 is the only aggrieved person in the FIR in question.

In view of the report of the learned Judicial Magistrate Ist Class, Ludhiana and the principles laid down by Hon'ble the Apex Court in Gian Singh Vs. State of Punjab and others (2012) 10 SCC 303, and also by the Full Bench of this Court in Kulwinder Singh and others Vs. State of Punjab and another, 2007(3) RCR (Criminal) 1052, the instant petition is allowed and FIR No.310 dated 09.11.2020 under Sections 420, 120-B, 506 IPC (Sections 465, 467, 468, 471, 447 IPC added later on) registered at Police Station Shahkot, District Jalandhar Rural and all subsequent proceedings arising therefrom, are quashed qua the petitioners. 7.
