RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to petitioner, namely; Jaskaran Singh @ Billa, in case FIR No. 4 dated 19.01.2020 registered under Section 22 of the NDPS Act at Police Station Sadar Hoshiarpur, District Hoshiarpur.

According to the prosecution, petitioner was apprehended with conscious possession of 175 grams of white power wrapped in a plastic bag, without any permit of licence.

Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to RISHU KATARIA 2020.07.23 14:07 I attest to the accuracy and integrity of this document
