(ORAL) Learned counsel for the petitioner submitted that his client was not properly advised in making prayer in the application for giving alternate land of 3 kanals instead of buying out share of the co-sharer arising out of preliminary decree, which had kept the question of construction open at the time of drawing of final decree. He would be moving an application in terms of provisions of the Partition Act and urges for leave of this Court for withdrawal of the revision with liberty to avail remedy aforementioned. Prayer of counsel for the petitioner is genuine and in accordance with law, thus, ordered accordingly. The trial Court shall decide the application uninfluenced with the finding rendered in this order.
