******* SURINDER GUPTA, J.(Oral) Above captioned petitions have been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to petitioners in case FIR No. 199 dated 04.09.2016 registered for the offence punishable under Sections 420 read with Section 34 of Indian Penal Code (for short 'IPC'), at Police Station Kotwali, District Bathinda. Heard.

Learned State counsel submits that Satinder Sehgal, petitioner in CRM-M-35093 of 2016, is posted as Deputy Manager in State Bank of India, Rampura Phul Branch, District Bathinda. Complainant is a retiree and having an account in said branch. She was advised by petitioner-Satinder

-2Sehgal to invest in the company of her daughter and nephew under the name and style of 'Fair Deal Consultant'. After withdrawing `8 lacs from her fixed deposit, she invested this money with 'Fair Deal Consultant', who further invested the money with 'Future Choice Company'. Interest on the amount of `8 lacs was paid for sometime by petitioner-Satinder Sehgal from her account. Future Choice Company has fled away and money invested by the complainant has not been returned.

Allegations against petitioner-Satinder Sehgal is that she advised the complainant to invest in 'Fair Deal Consultant'. Learned counsel for petitioners submits that Gunjot Kaur, petitioner in CRM-M-46444 of 2016 is in no manner connected with 'Fair Deal Consultant'. She is daughter of Satinder Sehgal and has been falsely implicated in this case. Company 'Fair Deal Consultant' is owned by Gurpreet Singh Sethi and petitioner-Gunjot Kaur has nothing to do with that company.

Gurpreet Singh Sethi has not been arrested so far. The matter relate to investment of `8 lacs made by the complainant. Keeping in view above facts but without expressing any opinion on merits of the case, these petitions are allowed and orders dated 27.10.2016 and 23.12.2016 passed in respective petitions are made absolute till the presentation of challan, subject to the following terms:- (i) that petitioners shall make themselves available for interrogation by the police as and when required; (ii) that petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him from disclosing such facts to the Court or to any police officer;

-3- (iii) that petitioners shall not leave India without the prior permission of the Court.

(iv) that petitioners will seek regular bail on the presentation of challan in Court.
