Instant petition has been filed under Section 483 of BNSS, 2023 (corresponding Section 439 of Cr.P.C.), for grant of regular bail to the petitioner - Dharminder Singh, who has been booked for having committed the offence punishable under Sections 109, 140, 303(2), 308(2), 310 of BNS, 2023 and 25 of the Arms Act, 1959 [Sections 309(4), 309(6), 118(2), 238, 3(5) of BNS, 2023, added later on], in FIR No. 81, dated 12.07.2024, registered at Police Station IT City, district SAS Nagar, Mohali. 2.

FIR was got registered at the instance of complainant Mainpal Singh, which reads as under:- "

Stated that I am a resident of the said address and drive in INDRIVE Company (taxi car). On 12.07.2024 midnight of 01, my car HR-45-D-3198 make Swift Dzire color white, I was standing at metro zirakpur road, then two unknown persons booked my vehicle to go to Zirakpur in online INDRIVE company and I sat these two persons in my car and one young man sat on the conductor seat and the other person sat on the back seat and both said that another person has to be picked from Airport Chowk Mohali and I started towards Airport road from Zirakpur.

- 2 - When I reached the airport chowk in Mohali, the time was around 1.50 AM, then the two young men said that you stop the vehicle here, our third partner is coming and I stopped my car airport chowk Mohali. I told them that you call that person, so that he will come soon. But they told me that he is coming. After 2/3 minutes, the young boy sitting on the conductor's seat pointed a pistol at my scalp and said, "give the key of the car." Meanwhile, the young boy sitting behind forcibly took my INDRIVE company mobile brand Vivo from my hand. When I refused to give the key, the young man sitting on the back seat hit me on my left shoulder with a sharp object like a knife and the second time on my right side, and the place where I was hit started bleeding and started hurting.

The young boy sitting on the conductor seat kicked me and threw me down from the car and one of them got out of the car and started kicking me and snatched the car key in my hand and started the car and ran away, so I jumped into the moving car and climbed on the top of the car and the young man sat on the front seat and drove the car towards Mohali. They turned from left to right to throw me down, but I was holding with my hand, so they made a U-turn from the Sector-82 light and drove the car towards Zirakpur towards Airport Chowk and they turned off the car light and stopped the car and I fell on bonut from the roof of the car and both of them came outside the car and I took the key of car from them and the other boy said to shoot him.

In this, the lights of the 2/3 cars came and a very loud honking sound was heard, then the two young boys left the car and ran away from the spot. The time is around 2.15 am. Then I called my friend Sagar Rana, son of Ram Pal, resident of Gohana, PS Nisig, District Karnal presently in tenanted premises at H. No. 325, Khuda Alisher, Chandigarh, PS Sector 1, Chandigarh (UT) from my other phone. Sagar Rana came at the spot and when I sat in my car, I saw a black mobile phone lying on the conductor seat mat. Which I kept with me and Sagar Rana took me in the vehicle and admitted me to GMSH Sector-16 Chandigarh. I was later discharged by the doctor. I have come to know that one of these youths is named Lucky alias Kala Son of Sanjeev Kumar resident of Ava Basti Ferozepur City.

I was coming to the police station to inform you with my friend Sagar Rana, so you found me at the Rudra International School near the turn of the police station. Learned counsel for the petitioner contends that petitioner is

- 3 - neither named in the FIR, nor he is involved in the present crime but has been falsely implicated therein. Nothing substantial was recovered from the possession of the petitioner after being arrested. Presently, petitioner is inside the jail since 20.07.2024, i.e., for a period of about more than 01 year and 07 months. 4.

At this stage, on asking certain questions, learned counsel appearing for the petitioner submits that he is the proxy counsel, as the arguing counsel is not available, thus, seeks a short accommodation. 5.

In view of this, instant petition is disposed of with a direction to file a fresh one on the same cause of action, if so advised, by incorporating all the factual aspects and after fully prepared with the arguments.
