IN THE HIGH COURT OF PUNJAB & HARYANA

AT CHANDIGARH CWP No.9765 of 2019 Date of decision:05.07.2019 Deepak ... Petitioner Vs.

State of Haryana and others ... Respondents

CORAM:

HON'BLE MR. JUSTICE AMIT RAWAL Present:- Mr. Satnam Sishodia, Advocate for the petitioner.

AMIT RAWAL J. (Oral) Petitioner has sought indulgence of this Court under Article 226/227 of Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to award 5 marks to him in terms of Advertisement No.3/2018 (Annexure P-1) as his father died before completion of 42 years of age.

Reasoning assigned is that while filling up form online at cyber cafe, petitioner had marked 'No' instead of 'Yes' and applied under wrong category, therefore, he was entitled to 5 marks. In this regard, reference has also been made to order dated 31.10.2018 passed by this Court in CWP No.14863 of 2017 titled as 'Sarla vs. State of Haryana and others' (Annexure P-7) whereby petitioner-Sarla therein had applied Economically Backward Person in General Castes (EBPG) category but candidature was cancelled on the ground that she filled the online form declaring her category as BCB. CWP No.9765 of 2019 {2} paper book. The judgment dated 31.10.2018 rendered in CWP No.14863 of 2017 (Annexure P-7) is in context of some other category whereby candidate had wrongly filled her category as BCB, though she belonged to Economically Backward Person in General Castes (EBPG) category. In the present case, petitioner has sought 5 marks extra belonging to category No.1 specified in advertisement in case parent of any candidate died before attaining the age of 42 years and was less than 15 years of age. The aforementioned relief cannot be granted as the entire process of selection is over. The petitioner who had applied for the post of Constable and did not fill-up the form correctly, cannot be expected to write a DDR.

Writ petition is dismissed.
