Khan Singh v. State Of Punjab
KAPIL 2015.10.13 15:11 I attest to the accuracy and integrity of this document CRM-M-34267-2015 [1] *** In the High Court of Punjab and Haryana at Chandigarh. CRM-M-34267-2015 Date of Decision: 12.10.2015 Khan Singh
...Petitioner
Versus
State of Punjab
...Respondent
CORAM: HON'BLE MRS. JUSTICE SABINA
Present:
Mr. P.S. Rai, Advocate, for the petitioner.
***** SABINA, J.
Petitioner has filed this second petition under Section 438 of Code of Criminal Procedure, 1973 for grant of anticipatory bail in FIR No.144, dated 24.09.2014, under Sections 420, 465, 467, 468, 471, 120-B and 511 of the Indian Penal Code, 1860 registered at Police Station City Jalalabad, District Fazilka.
Heard.
Earlier petitioner had filed CRM-M-17445-2015 seeking concession of pre-arrest bail. The said petition was dismissed by this Court vide order dated 27.05.2015 and the said order reads as under:- "Petitioner seeks the concession of prearrest bail in case F.I.R. No.144 dated 24.9.2014 under Sections 420, 465, 467,

During the course of arguments it stands conceded that the petitioner on account of having evaded the process of law has been declared a Proclaimed Offender vide order dated 10.4.2015, passed by the Trial Court.
Petitioner's conduct disentitles him for the concession of pre-arrest bail.
Petition, accordingly, is dismissed."
Thus, the earlier petition filed by the petitioner was dismissed on the ground that he was a proclaimed offender. Admittedly, situation is still the same as petitioner has failed to surrender before the trial Court.
In these circumstances and in view of the dismissal of the earlier petition filed by the petitioner seeking anticipatory bail, no ground for grant of anticipatory bail to the petitioner, is made out.
Dismissed.
