(Oral) As identical points to grant the concession of anticipatory bail to the petitioners, are involved, therefore, I propose to dispose of above-said petitions, arising out of the same case/FIR, by means of this common order, to avoid the repetition of facts.

Petitioners have preferred the instant separate petitions for the grant of anticipatory bail in a case arising out of FIR No.236 dated Naresh Kumar 2016.12.05 17:14 I attest to the accuracy and integrity of this document Chandigarh 01.09.2015, registered at Police Station City Sangrur, for the commission

CRM-M-34280-2015 & -2CRM-M-33631-2015 of offences punishable under Sections 498-A, 406 and 323 IPC. Vide orders dated 07.10.2015 of this Court, the anticipatory bail was granted to the petitioners to enable them to join the investigation and thereafter, the matter was referred to the Mediation & Conciliation Centre of this Court, vide order dated 08.08.2016 to enable the parties to settle the disputes. On 16.11.2016, the case was sent back to this Court for further adjudication as the conciliation efforts between the parties have not been materialized.

Learned State counsel on instructions from investigating officer has informed that the recovery of 7 tolas of gold is still to be effected from the petitioners.

In view of the totality of the facts and circumstances of the case, order dated 07.10.2015, passed by this Court whereby the ad-interim anticipatory bail was granted to the petitioners is made absolute, subject to the condition that the petitioners deposit a sum of ` 70,000/- in the shape of FDR in the name of the minor child of the complainant, namely, Garvi, before the trial Court, within a period of two weeks, from the date of receipt of certified copy of this order. Moreover, the petitioners shall continue to join the investigation as and when required to do so and abide by all the conditions as envisaged under Section 438 (2) Cr.P.C. Accordingly, the present petitions stand disposed of.
