The matter is taken up for hearing through video conference due to COVID-19 situation.
This is a petition for regular bail in FIR No. 84, dated 7.5.2019, under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station City Jagraon, District Ludhiana.
The facts as per the FIR are that an information was received by the patrolling party on 7.5.2019 that Sandeep Kumar @ Monu sells and distributes intoxicant tablets in huge quantity and he is carrying heavy quantity of tablets. A raid was conducted and 26000 tablets of Alpra Zolam Alpz-Fort and 16000 tablets of Clonazopam Klozaps were recovered from him.
Learned counsel for the petitioner submits that the petitioner is in custody since May, 2019, he is a licenced dealer and deals in whole sale supply of drugs and he is not involved in any MANOJ KUMAR 2021.02.08 23:26 I attest to the accuracy and integrity of this document

Learned counsel for the State has filed affidavit of Joing Commissioner (Drugs)/ State Drugs Controller, Food and Drug Administration, Punjab near Civil Hospital, Kharar, District SAS Nagar (Mohali) dated 4.2.2001. As per the said affidavit, the petitioner is authorised to keep tablets upto 50000. Considering that the petitioner is wholesale license holder and authorised to keep 50000 tablets in stock, his custody period and also the fact that conclusion of trial is likely to take time, the petitioner is granted bail subject to his furnishing bail bonds to the satisfaction of Chief Judicial Magistrate/ Duty Magistrate concerned.
It is clarified that observations made hereinabove shall not be construed as an expression of opinion on the merits of the case.
