(Oral) This petition has been filed challenging the order dated 10.09.2015 vide which the evidence of the petitionercomplainant/prosecution has been closed. It has been recorded in the order that sufficient opportunities including the issuance of bailable/non-bailable warrants were granted to the prosecution and that is why order closing evidence had to be passed. Learned counsel for the complainant-petitioner states that the matter is fixed for tomorrow and the complainantpetitioner undertakes to appear herself and ensure that evidence is closed tomorrow itself and would not seek any further opportunity for leading evidence.

CRM-M No.34312 of 2015 because the petitioner-complainant had not appeared and their statements have also been recorded under Section 313 Cr.P.C. In my opinion these two facts can be remedied. In case any further evidence is lead tomorrow, the accused would be entitled to lead defence evidence and also get their statements recorded under Section 313 Cr.P.C. afresh. With this limited relief the present petition is disposed of.
