(Oral) It is submitted by learned counsel for the petitioner that vide impugned order dated 03.03.2020 (Annexure P-1) the application filed by the respondent/defendant under Order 7 Rule 11 CPC was allowed. It is submitted that accordingly as per Section 2 of CPC, appeal is maintainable against the same. However, under the mistaken legal apprehension, the Revision Petition has been filed. Learned counsel for the petitioner seeks withdrawal of the present petition with liberty to file appropriate proceedings as per law and also prays exemption under Sections 5 and 14 of the Limitation Act for filing the same.
