JASWANT SINGH, J (ORAL) Prayer is for grant of regular bail in case FIR No.104 dated 16.6.2015 under Sections 302,394,109,118,177,182,120-B IPC read with Sections 25/54/59 of the Arms Act, P.S Maqsudan, Jalandhar. As per the prosecution story unfolded in the aforesaid investigation, Palwinder Kaur @ Reeta/the wife of deceased-Kuldeep Singh along with her paramour Gurdeep Singh @ Sonu and three other co-accused namely Jagjit Singh @ Jaggi, Jatinder Singh @ Honey and Sukhchain Singh @ Gopi caused the murder of Kuldeep Singh. Accused Gurdeep Singh @ Sonu is alleged to have shot the deceased whereas rest of them facilitated the crime. The role of the petitioneraccused Varinder Singh @ Bindu is that he facilitated the purchase of a country-made pistol along with 11 cartridges from Uttar Pradesh. Learned counsel for the petitioner submits that the petitioner is in custody since 03.07.2015 and the investigation qua him
CRM-M- 34326 of 2015 #2# are over apart from the fact that there is no role in conspiracy of causing murder of the deceased.
Learned state counsel, on instructions from ASI Raghubir, concedes that the investigations qua the petitioner are over and challan has been presented.
Without commenting upon the merits of the case and taking into account the role ascribed to the petitioner and the fact that the trial is not likely to be concluded in near future, no useful purpose would be served by keeping the petitioner behind the bars. Accordingly, the present petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate Jalandhar.
