( Through Video Conferencing ) *** HARSIMRAN SINGH SETHI, J. (ORAL) In the present writ petition, the petitioner is seeking selection for post of Lower Division Clerk, in pursuance to the advertisement No.11/2019 dated 05.07.2019, by which 495 posts were advertised by respondent No.1.

Learned Senior counsel appearing on behalf of the petitioner submits that out of said 495 posts, 18 posts were to be filled up from the category of Ex-servicemen General Category including the Dependents of the Ex-servicemen Category i.e. the category to which the petitioner belongs. Learned Senior counsel further submits that the petitioner has 85 marks to his credit and in the final result declared, the last candidate, who is stated to be dependent of Ex-servicemen, has obtained 59 marks and therefore, exclusion of the petitioner from the selection by the NARESH KUMAR 2021.06.28 16:18 I attest to the accuracy and integrity of this document

CWP-10546-2021 -2respondents is totally arbitrary, illegal and without any valid justification. Learned Senior counsel for the petitioner further submits that all the facts have already been brought to the notice of respondent No.1 by the petitioner by giving a detailed demand notice dated 03.05.2021 (Annexure P-4), which is still pending consideration with respondent No.1 and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to respondent No.1 to decide the said demand notice dated 03.05.2021 (Annexure P-4).

Notice of motion.

Mr. Sharad Aggarwal, AAG, Haryana, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondent-State and raises no objection with regard to prayer of the petitioner for deciding the demand notice dated 03.05.2021 (Annexure P-4) by respondent No.1 in a time bound manner by passing an appropriate speaking order. In view of the above, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No.1 is directed to decide the demand notice dated 03.05.2021 (Annexure P-4) by passing a speaking order within a period of six weeks from the date of receipt of a copy of this order.

Present writ petition stands disposed of.
