Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in FIR No.117, dated 07.09.2015, under Sections 323, 325, 326, 508, 307, 148, 149 and 120-B of the Indian Penal Code, 1860, registered at Police Station Mehtiana, District Hoshiarpur. Heard.

Prosecution story, in brief, is that accused Sukhraj Singh @ Sukha was armed with a Vanja, at the time of occurrence. Petitioner was armed with baseball bat, whereas, Ashwani Kumar @ Happy was armed with kirpan and Narinder Singh @ Mogli, accused was armed with baseball bat. All the accused have inflicted injuries on the person of the injured. So far as petitioner is concerned, he has been attributed a blow on the left wrist of the injured. The said injury

Petitioner is in custody since 10.09.2015. Injured has since been discharged from the hospital. There is no opinion of the doctor to the effect that any of the injury on the person of the injured was dangerous to life.

Keeping in view the facts and circumstances of the case and without expressing any opinion on merits, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Hoshiarpur. October 13, 2015 (SABINA) kapil JUDGE
