CRM No.M-34403 of 2014 [2] It is submitted that possession of the residential house in question has since been handed over to complainant, Atma Singh. This fact has been verified and affirmed by learned counsel for the State, on instructions from SI Jagtar Singh as well as the complainant. It is also verified that petitioner in pursuance of order dated 04.12.2014 has joined investigation. No recovery is to be effected from the petitioner and his custodial interrogation is no longer required. There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Keeping in view the facts and circumstances of the case but without commenting or expressing any opinion on the merits thereon, it is considered just and expedient to allow this petition. In the event of arrest of the petitioner, he shall be released on bail by the Arresting/Investigating Officer to his satisfaction. Petitioner shall comply with the conditions stipulated in Section 438(2) Cr.P.C.

Petition is allowed.
