NARESH KUMAR SANGHI, J. (Oral) Learned counsel for the petitioner prays for withdrawal of the present petition to enable the petitioner to challenge the summoning order by way of criminal revision petition before the Court of Session at the first instance. He further submits that personal appearance of the petitioner on each date of hearing may be exempted.

After hearing learned counsel for the parties, the petitioner is permitted to withdraw the present petition to enable him to file revision petition before the Court of Session at the first instance, in accordance with law. If the petitioner moves an application for grant of exemption from personal appearance on each date of hearing before learned Trial Court, the same shall be considered in view of the fact that the petitioner is presently residing in Muscat.
