As per the office report, letter issued to learned counsel for the appellant has been received back with the report that his brief has been taken away by the party concerned. Similarly, letter issued to learned counsel for respondent Nos.1 and 2 has also been received back with the report that he will check whether the case belongs to him or not. Accordingly, fresh notices were also issued to the parties by the Registry. Notice issued to the sole appellant has been received back with the report of incomplete address. Similarly, notice issued to respondent No.2 has also been received back with the report of incomplete address. Legal representatives of respondent No.1 stand duly served by way of publication, however, no one has put in appearance on their behalf.

There is no other address available with the Court for effecting service on the appellant except the one mentioned in the memo of parties and in the judgments and decrees passed by the Trial Court and the First Appellate Court and is the same on which the notice was sent. Ankur Goyal 2024.10.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.

Dismissed for non-prosecution with liberty to revive in case anything survives in the matter. Pending applications, if any, also stand disposed off.
